ONLINE SALES TERMS

THE FOLLOWING TERMS AND CONDITIONS (“ONLINE SALE TERMS”) REFERENCE AND INCORPORATE THE tix4cause TERMS OF USE, INCLUDING, WITHOUT LIMITATION, LIMITATIONS OF LIABILITY AND WARRANTY DISCLAIMERS.  YOUR SALE AND/OR PURCHASE OF EVENT TICKETS (“TICKETS”) ON tix4cause.com (“WEBSITE”), OWNED AND OPERATED BY TIX 4 CAUSE, LLC (“TIX4CAUSE”) IS SUBJECT TO THE ONLINE SALES TERMS.  THE ONLINE SALE TERMS MAY HAVE CHANGED SINCE YOUR LAST VISIT TO THE WEBSITE.  BY PURCHASING AND/OR DONATING TICKETS ON THE WEBSITE, YOU INDICATE YOUR ACCEPTANCE OF THE ONLINE SALE TERMS EFFECTIVE ON THE DATE OF YOUR PURCHASE OR SALE.  CAPITALIZED TERMS NOT DEFINED IN THE ONLINE SALE TERMS SHALL HAVE THE SAME MEANING AS IN THE TERMS OF USE.

Ticket Donors

After registering on the Website, you may donate Tickets through the Website, with up to one hundred percent (100%) of Ticket Proceeds to be donated to a non-profit organization (“Cause”) selected by you among tix4cause Cause members.  As used herein, “Ticket Proceeds” shall mean sale proceeds actually collected by tix4cause (and not subject to refund or contingencies) after deduction of any shipping charges incurred by tix4cause for timely delivery of your hard-copy Tickets to tix4cause’s processing center. For each Ticket you donate, you must state prominently and unambiguously the price you wish Tix4Cause to list on the website on behalf of the Cause. tix4cause reserves the right to charge service charges and delivery fees in addition to the Ticket price listed by you, and such fees will not be deemed “Ticket proceeds” hereunder, and will not be included in the donation amount. You are prohibited from donating Tickets in any manner that is deceptive or fraudulent or which would violate any laws (including, without limitation, consumer protection laws of any jurisdiction), regulations or tix4cause policies.  tix4cause reserves the right to refuse any Ticket for any reason.

If the Tickets you offer are electronic tickets, you must email them to tix4cause or direct the relevant ticket source to email them to tix4cause, no later than two (2) business days prior to the date of the applicable event. If the Tickets you offer are paper tickets, you must mail them to tix4cause’s designated address at least ten (10) business days prior to the date of the applicable event.  For each Ticket provided to tix4cause, you must properly, clearly and completely fill in the form provided by tix4cause (“Donation Form”) and include such Donation Form with your Ticket, in paper form or electronic form, as applicable. You may not amend a Donation Form once it has been submitted, and its terms, including with respect to Ticket price and beneficiary Cause, shall be binding on you. Upon receipt of your Ticket, and properly filled Donation Form, the Ticket shall be deemed donated and tix4cause will provide you with a donor acknowledgment form from the Cause you designated to benefit from the Ticket donation.

If the Cause designated in your Donation Form is not a tix4cause member Cause, and is a 501(c) (3) non-profit entity, tix4cause will invite such Cause to become a member in the tix4cause program.  Should such Cause refuse to participate, tix4cause reserves the right to donate the proceeds of the applicable Ticket to a Cause selected by tix4cause in its sole discretion; whenever feasible, tix4cause will endeavor to select an alternate Cause that supports a mission similar to the Cause designated in your Donation Form.

tix4cause does not warrant that any Tickets will be sold. Without limiting the generality of the foregoing, tix4cause does not warrant that Tickets sent past the deadline set forth above will be made available on the Website.  Tickets not sold at least twenty-four (24) hours prior to the date of the applicable event may be donated by tix4cause to the Cause designated in your Donation Form, or, if such Cause is not in a position to make use of such Tickets, to a Cause selected by tix4cause in its sole discretion. tix4cause does not warrant that any unsold Tickets will be donated or used.

Ticket Buyers

After registering on the Website, you may purchase Tickets through the Website.  Tickets are subject to a per-Ticket service charge and per-order delivery fee, as identified on the Website prior to your purchase. Once you have submitted an order, your purchase is non-refundable and your order cannot be changed. Neither the purchase price of the Ticket, nor the processing or delivery fees, nor any taxes, will be refunded to you under any circumstances, unless tix4cause cancels your order.

Each Ticket is a license to attend a particular event, and is subject to the additional terms set forth on that Ticket.

All Ticket prices for events that occur in the United States or in Canada are stated in U.S. Dollars.

Event dates, times, venues and subject matter listed on the Ticket may change. It is up to you to stay apprised of any changes. tix4cause is not responsible for notifying you of any such changes.

tix4cause is not in any way involved with the event for which you are purchasing Tickets. You hereby release tix4cause and all affiliated companies,  charities,  officers, directors, agents, parents, subsidiaries, legal representatives and employees (the “tix4cause Parties”) from, and the tix4cause Parties shall not be responsible for any claims, demands or damages of any kind in any way connected with, any dispute between you and the event promoter or relevant team or performer. You further acknowledge and agree that the tix4cause Parties shall not be liable for, and you hereby release each from, any loss or liability incurred in connection with attendance at an event for which Tickets were purchased on the Website.

It is your responsibility to read all tix4cause emails related to your order and to ensure that all of the information you provide in connection with your order is accurate. You hereby release tix4cause from any responsibility for missed confirmations or orders due to incorrect information provided by you.

tix4cause reserves the right to cancel any Ticket order without liability for any reason, including, without limitation, in the event it becomes aware that a Ticket is listed or charged at an incorrect price or you are able to purchase more tickets than the tix4cause purchasing guidelines allow, regardless of whether due to human error or a transactional malfunction of the Website or other tix4cause-related system. If your credit card has already been charged for the purchase and your order is canceled or changed, tix4cause shall immediately issue a credit for the amount affected.

Donations to Our Member Charities

Up to one hundred percent (100%) of Ticket Proceeds are donated to the Cause selected by the Ticket donor.  Ticket Proceeds do not include any service charges or delivery fees paid in connection with your purchase of a Ticket; accordingly, the amount of such fees will not be included in the donation amount.

Delivery Policy

If the Ticket you purchase is in electronic form, tix4cause will email it to you free of charge.  If the Ticket you purchase requires physical delivery, you will be charged a delivery fee based on the delivery option selected by you as part of the ordering process. Should Will Call pick-up be available at the venue, pick-up instructions will be identified on the Website or emailed to you.

tix4cause’s policy is to process and ship orders within twenty-four (24) hours of your order. Expedited processing may be available for an additional fee.  Once your order has been processed and shipped, you will receive your order tracking information via email confirmation. No refunds will be available for delayed deliveries that are in compliance with this policy.

Event Cancellation Policy

Occasionally, events may be cancelled or postponed by event management, the promoter, band, team or venue.  Neither tix4cause nor its Cause members shall have any responsibility with respect to any changes in the date, time or place of any event for which you purchase Tickets. No refunds are available for any postponed event if your original Tickets remains honored for the rescheduled event. Cancellation policies are to be determined by the particular venue and can vary from event to event. Generally, event management will refund the face value of a Ticket after a cancellation is confirmed. Neither tix4cause nor its Cause members shall be responsible for any refund that may be owed to you by event management, the event promoter, band, team or venue.  Service charges and delivery fees are not refundable under any circumstances.
